These Terms & Conditions ("Terms") govern your access to and use of services provided by Weblico ("we", "us" or "our"). By subscribing to or using any of our plans you agree to these Terms. If you do not agree, please do not use our services.
1. Services & Subscriptions
1.1 Plans Offered
We provide services under three subscription models:
- Launch Plan – Entry-level website setup with limited scope. Availability limited to 5 new clients per month.
- Growth Plan – Comprehensive website, marketing and optimisation services.
- Flexi Plan (VIP) – Advanced, customizable features and premium support. The Flexi VIP offer is only available to Growth Plan subscribers who have maintained an active Growth subscription for at least 3 months.
1.2 Scope of Service
Each plan includes the features listed on the Weblico website and related offer pages. Specific inclusions and limits per plan are set out on the plan pages and in the applicable offer terms. Additional services and add-ons are available for an extra fee where stated.
1.3 Exclusions
Unless explicitly included in your plan or agreed in writing, services such as premium third-party plugins, paid integrations, large custom builds, or complex back-end development are excluded and billed separately.
2. Payments & Billing
2.1 Billing Cycle
Subscriptions are billed monthly or annually in advance. Annual subscriptions may include promotional discounts which require commitment for the billed period.
2.2 Payment Methods
We accept major credit/debit cards, EFT and other payment methods as listed at checkout. Clients must ensure payment details are valid and up to date.
2.3 Refunds
Unless otherwise agreed in writing, Weblico does not provide refunds for partial months or unused services. Setup, onboarding and special fees are non-refundable unless explicitly stated.
3. Standard Plan Transition Policy
3.1 Upgrades
Clients may upgrade plans at any time (e.g., Launch → Growth, Growth → Flexi) subject to eligibility requirements. Flexi VIP is only available to qualifying Growth clients (minimum 3 months active Growth subscription). When you upgrade, pro-rated charges may apply for the current billing cycle.
3.2 Downgrades
Downgrades require at least thirty (30) days' notice and take effect from the next billing cycle. Downgrading may result in the loss of features, add-ons or promotional benefits associated with the higher tier.
3.3 Add-Ons
Add-ons are billed separately and are cancellable with 30 days' notice unless otherwise specified. Promotional add-ons (trial periods, discounts) revert to standard pricing once the promotion ends.
4. Client Responsibilities
- Provide accurate content, images, branding assets and timely approvals required for project delivery.
- Supply hosting and domain credentials when requested (unless Weblico is managing hosting on your behalf).
- Ensure all content you provide is lawful and you hold the necessary rights (copyright, permissions, licenses).
- Respond to Weblico communications and milestone requests within a reasonable timeframe; delays may affect delivery timelines.
5. Intellectual Property
5.1 Client Content
You retain ownership of all content (text, images, media) that you supply to Weblico for your website.
5.2 Weblico Deliverables
Upon receipt of all due payments and subject to these Terms, Weblico grants you a non-exclusive licence to use the delivered website and related assets for your business purposes. Weblico retains ownership of proprietary tools, templates, libraries or components not expressly transferred in writing.
5.3 Third-Party Licenses
Any third-party themes, plugins or services used in your site are subject to their own license terms. You are responsible for any additional licensing fees required by those third parties.
6. Support & Service Limitations
Support levels vary per plan. Launch Plan includes limited support as defined on the plan page. Growth and Flexi include ongoing maintenance and support as described in their plan details. “Unlimited small updates” refers to minor changes (text swaps, image replacements). Major redesigns, new feature development or extensive content migrations are billed separately.
7. Disclaimers & Limitation of Liability
Weblico aims to provide professional services but does not guarantee specific business outcomes (such as search rankings, traffic or sales). To the fullest extent permitted by law, Weblico’s total liability for any claim arising out of or relating to these services is limited to the amount you paid Weblico in the three (3) months immediately preceding the event giving rise to the claim.
8. Termination & Cancellation
Either you or Weblico may terminate a subscription with thirty (30) days' written notice. Weblico may suspend or terminate services immediately if you fail to pay fees due, materially breach these Terms, or use the services for unlawful purposes. On termination, any outstanding fees remain payable. If you cancel, Weblico may remove hosted resources (sites, backups) as set out in your plan terms.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of South Africa. Parties will attempt to resolve disputes amicably via written correspondence. If unresolved, disputes shall be referred to arbitration under applicable South African arbitration rules unless agreed otherwise in writing.
10. Changes to Terms
Weblico may update these Terms from time to time. We will notify clients of material changes via email or through the client dashboard. Continued use of our services after notification constitutes acceptance of the updated Terms.
